Epic Games is facing union action from SAG-AFTRA due to Fortnite's recent introduction of an AI-powered Darth Vader, which delivers voice lines based on archived recordings of James Earl Jones.

The complaint, which was filed May 19, takes aim at the AI-powered performance. Not specifically due to its use of AI, but because the union's collective bargaining agreement outlines that performances involving deceased members must be notified or negotiated directly with the union.
"Fortnite's signatory company, Llama Productions, chose to replace the work of human performers with A.I. technology. Unfortunately, they did so without providing any notice of their intent to do this and without bargaining with us over appropriate terms," the union wrote
The James Earl Jones Estate reportedly approved the use of the late actor's voice, expressing eagerness for the partnership to "allow new generations to enjoy the character." In-game, the AI recreation of Darth Vader allows players to interact with the Sith Lord, responding to users' conversational cues and even reading out their in-game usernames.
However, the union still argues that Epic Games made "unilateral changes to employment terms and conditions" due to the lack of notice and bargaining around the feature's inclusion.
The subject of AI in Hollywood remains a key concern, with the SAG-AFTRA union's long-running campaign heavily emphasizing AI protections for its members. The union's official stance is not necessarily opposed to AI, but focuses on the issue of protecting digital likeness, artist control over performances, and more.
As of May 20. Epic Games has not issued a public response to the union's complaint.
